CHAPTER 14. TRAFFICCHAPTER 14. TRAFFIC\Article 1. Standard Traffic Ordinance

There is hereby incorporated by reference for the purpose of regulating traffic within the corporate limits of the City of Florence, Kansas, that certain standard traffic ordinance known as “Standard Traffic Ordinance for Kansas Cities”, Edition of 2023, prepared and published in book form by the League of Municipalities, Topeka, Kansas, save and except such articles, sections, parts or portions as are hereafter omitted, deleted, modified or changed. Not less than three (3) copies of said Standard Traffic Ordinance shall be marked or stamped “Official Copy as Adopted by the Code of the City of Florence”, with all sections or portions thereof intended to be omitted or changed clearly marked to show any such omission or change and to which shall be attached a copy of the related ordinance or code article, and filed with the City Clerk to be open to inspection and available to the public at all reasonable hours. The police department, municipal judge and all administrative departments of the City charged with enforcement of the Ordinance shall be supplied, at the cost of the City, such number of official copies of such Standard Traffic Ordinance similarly marked, as may be deemed expedient.

(a)   An ordinance traffic infraction is a violation of any section of this ordinance that prescribes or requires the same behavior as that prescribed or required by a statutory provision that is classified as a traffic infraction in K.S.A. Supp. 8-2118.

(b)   All traffic violations which are included within this chapter, and which are not ordinance traffic infractions, as defined in subsection (a) of this section, shall be considered traffic offenses.

The fine for violation of an ordinance traffic infraction of any other traffic offense for which the municipal judge establishes a fine in a fine schedule shall not be less than $10.00 nor more than $100.00. A person tried and convicted for violation of an ordinance traffic infraction or other traffic offense for which a fine has been established in a schedule of fines shall pay a fine fixed by the court not to exceed $500.00.

Section 33 of Article 7 of the Standard Traffic Ordinance for Kansas Cities is here by amended to read as follows:

SECTION 33: MAXIMUM SPEED LIMIT.

(a)   Except when a special hazard exists that requires lower speed for compliance with Section 32, the lower limits specified in this Section or established as hereinafter authorized shall be maximum lawful speeds, and no person shall drive a vehicle at a speed in excess of such maximum speeds:

(1)   Twenty (20) miles per hour in any business district;

(2)   Thirty (30) miles per hour in any residential district, except in (6) below;

(3)   Twenty (20) miles per hour in a park;

(4)   Twenty (20) miles per hour on Barker Street from Eighth Street to Ninth Street; and

(5)   Forty-five (45) miles per hour in that portion of U.S. Highway 77S to intersection of Hwys 50 & Hwy 77N of the intersection of Hwys 50 & 77 and all of Hwy 50.

(6)   During the school term and between the hours of 8:00 a.m. to 4:00 p.m., the maximum speed on the following named street shall be twenty (20) miles per hour, to wit:

Eighth Street between Kimball and Doyle Streets;

Seventh Street between Dean and Doyle Streets;

Doyle Street between Seventh and Eighth Streets;

The maximum speed limits established by or pursuant to this paragraph shall be in force and effect regardless of whether signs are posted giving notice thereof and notwithstanding any signs giving notice of maximum speed limits in excess thereof, and any signing notice of a maximum speed limit in excess of the limits established by or pursuant to this paragraph shall not be of any force or effect.

(b)   No person shall drive a school bus to or from school or interschool or intraschool functions or activities at a speed greater than forty-five (45) miles per hour on any roadway having dirt, sand or gravel surface, and in no event shall a school bus be driven to and from school or activities in excess of fifty-five (55) miles per hour, notwithstanding any maximum speed limit in excess thereof. The provisions of this subsection shall apply to buses used for the transportation of students enrolled in community junior colleges or area vocational schools when such buses are transporting students to or from functions or activities.

In addition to those violations set forth in the Standard Traffic Ordinance for Kansas Cities, it is hereby declared therefore a traffic infraction for a driver of a motor vehicle to commit any of the following acts on any street in the City of Florence, Kansas, to wit:

(a)   The crossing of the center-line of the roadway except to enter a driveway or alley.

(b)   The making of turns other than at the end of a block, in order to park on the opposite side of the street.

(c)   Backing across the center-line of the street in order to proceed in the opposite direction except from driveways or alleys.

(d)   To drive a motor vehicle across or over a street curb unless he drives through or on a driveway approach or other curb cut across which traffic is intended.

In addition to those violations set forth in the Standard Traffic Ordinance for Kansas Cities, it is hereby declared therefore a traffic infraction for a driver of a motor vehicle to commit any of the following acts on any street in the City of Florence to-wit:

(a)   The crossing of the center-line of the roadway except to enter a driveway or alley.

(b)   The making of turns in order to park on the opposite side of the street.

(c)   Backing across the center-line of the street in order to proceed in the opposite direction except from driveways or alleys.

The Chief of Police of the City of Florence shall further have the authority to place other traffic control signs, including but not limited to stop signs and no parking signs in the City of Florence, either temporarily or permanently, at any intersection where he believes such is necessary for safety of drivers, pedestrians or bicyclists.

No person shall park a vehicle at anytime on the east right-of-way along Highway 50 from the intersection of Fifth Street and Highway 50 to where Highway 50 crosses the city limits in the Southwest corner of said City.

Any person convicted of a violation of this chapter shall be punished as and for a traffic infraction under the Standard Traffic Ordinance. The judge of the municipal court is hereby authorized to set a fine which shall be not less than $100.00 but not more than $500.00, which shall be imposed upon a voluntary entry of appearance and a plea of guilty or no contest as to such a violation, along with payment of such fine, and any applicable court cost.
