It shall be unlawful for any person or persons, company or corporation maintaining a business patronized by the public to set up or keep any pool tables, billiard tables, snooker tables, shuffleboards, coin operated pinball machines, coin operated music machines, bowling alleys, or any other coin operated amusement devices in any building in the City of Florence, Kansas, without first taking out and having a license for each building in which any said table or machine is kept and operated and without complying with the regulations and requirements concerning same hereafter set out.

Before a license shall be issued for any of the purposes aforesaid, the person or persons, company or corporation desiring the license shall file with the City Clerk a written, verified application stating the building or buildings in which they desire to set up and operate their pool tables, billiard tables, snooker tables, shuffleboards, bowling alleys, coin operated pinball machines, coin operated music machines, or any other coin operated amusement devices; and said applicant shall further designate the kind and number of said tables or machines to be operated in each building; and, thereupon, the City Clerk shall issue such license for the building or buildings set out in such application upon payment of the license tax therefor as hereinafter provided, which license shall be signed by the Mayor and attested by the City Clerk with the seal of the City of Florence, and which license shall expire on the last day of December of each year.

Any applicant not desiring to license all of said tables or machines located in his place of business shall render such tables or machines for which he does not desire a license inoperable at the time application is made for such license as above set forth and shall specify in such application which of said tables or machines are not to be licensed.

The amount to be levied and collected for each said license issued under the provisions of this article shall be based upon the sum of Ten Dollars ($10.00) per year or any part thereof for each pool table, billiard table or snooker table to be operated in such building and shall be further based upon the sum of Two Dollars and Fifty Cents ($2.50) per year or any part thereof for each shuffleboard, coin operated pinball machine, coin operated music machine, or any other coin operated amusement device to be operated in such building as set out in said application.

The applicant, upon receiving said license from the City of Florence, for the operation of such tables or machines as aforesaid in any said building, shall immediately cause said license to be securely attached in a prominent place in said building; and the absence of any such license in any of said buildings aforesaid shall be deemed prima facie evidence that no license aforesaid has been issued by the City of Florence for said tables or machines situated therein.

Any table or machine aforesaid found to be operating within any building in the City of Florence for which no license herein has been issued by said City may be seized and sold according to law and the proceeds therefrom shall be applied first to the cost of such seizure and sale, then to the payment of such license fee established herein, and the balance, if any, to be paid to the owner of such table or machine.

Any person or persons, company or corporation violating any of the provisions of this article shall, upon conviction thereof, be fined in a sum not to exceed One Hundred Dollars ($100.00) for each such offense.
