Article 2. City Planning Commission

There is hereby created the Florence City Planning commission which shall consist of seven (7) electors of which five (5) members shall be residents of the City and two (2) shall reside outside the City but within three (3) miles of the corporate limits of the City.

The members of the Planning Commission shall be appointed by the Mayor with the consent of the City Council. The members of the Commission first appointed shall serve respectively for terms of one (1) year, two (2) years, and three (3) years, divided equally or as nearly equal as possible between those terms. Thereafter, all members shall be appointed for terms of three (3) years each. All terms shall commence the first day of May, commencing with the year 1977, and expiring on the last day of April. The appointments shall be so made that the terms of office of the members residing outside of the corporate limits of the City do not expire within the same year. Two (2) of the members first appointed shall serve until April 30, 1978; two (2) shall serve until April 30, 1979; and three (3) shall serve until April 30, 1980. In case of death, incapacity, resignation, or disqualification of any member, appointment to such a vacancy on the Commission shall be made as herein provided for only the unexpired term of the member leaving the membership. None of the commission members shall hold any other public office or position with the City. Members of the Commission shall serve without compensation, but may be reimbursed for expenses actually incurred in the performance of their duties.

The members of the Planning Commission shall meet at least once a month at such time and place as they may fix by resolution. They shall select one (1) of their number as chairman and one (1) as vice-chairman who shall serve one (1) year and until their successor has been elected. Special meetings may be called at any time by the chairman or in his absence by the vice-chairman. A majority of the Commission shall constitute a quorum for the transaction of business. The Commission shall cause a proper record to be kept of its proceedings. In order to properly maintain records of the proceedings, the Commission shall annually appoint a secretary who may be a member of the Commission or any employee of the City. Should any member have an interest, either directly or indirectly in any application coming before the Planning Commission, he shall be disqualified to discuss or vote on the matter.

The City Council and Planning Commission shall have all the powers and duties as set forth in K.S.A. 12-701 through 12-713, inclusive, and such other powers and duties as are now or may hereafter be prescribed by law. The Commission is hereby authorized to make or cause to be made and adopted a comprehensive plan for the City and any unincorporated territory lying outside of the City but within the county in which the City is located, which in the opinion of the Commission forms the total community of which the City is a part. The Commission shall cause to be prepared zoning studies and a zoning ordinance, and shall make recommendations on the zoning of all land within the jurisdiction designated by the Council. The Commission shall also cause to be prepared and adopted recommendations governing the control of subdivisions within an area designated by the City Council.

On or before the first Monday in July of each year the Planning Commission shall prepare and submit to the City Council its budget of expenditures for the ensuing budget year, itemizing the expenses and amounts and the purpose. The Council shall thereupon consider said budget and make such allowances to the Commission as it shall deem proper, including funds for the employment of such employees or consultants as the Council may authorize and provide, and shall add the same to the general budget of the City; Provided, that the Council may, prior to the time that moneys are available under the budget as herein provided, appropriate moneys for such purposes from the general fund. The Council may enter into such contracts as it may deem necessary for the purposes of this article and may receive and expend funds and moneys from the state or federal government or from any other source for such purpose. The City Treasurer of the City of Florence is hereby designated as the custodian and disbursing agent for the total budget.
