(a) City Library, herein referenced as the Florence Public Library, shall be free to the use of the inhabitants of the City of Florence, as provided in K.S.A. 12-1227 and amendments thereto;
(b) Board Meetings The library board, herein referenced as the Florence Library Board of Trustees, shall meet as follows’
(1) Each year the members of the library board shall meet and elect a chairperson, a treasurer, and such other officers as they may deem necessary;
(2) The board shall also fix the date and place of its regular meetings;
(3) Special meetings may be called by the chairperson or upon written request of a majority of the members. Written notice, stating the time and place of any special meeting and the purpose for which called, unless waived, shall be given to each member of the board at least two days in advance of such meeting, and no business other than that stated in the notice shall be transacted at such meeting.
(c) Treasurer. The treasurer of the library board shall give bond, in an amount fixed by the library board and approved by the governing body of the City of Florence, for the safekeeping and due disbursement of all funds that may come into the treasurer’s hands. The bond shall be filed with the city clerk. Except where otherwise provided by law, the city clerk shall pay over to the treasure of the library board all funds collected for the maintenance of the library, and treasurer of the library board shall pay out the fund on orders of the library board signed by the secretary and chairperson thereof. Such treasurer shall keep an accurate record of all moneys received and disbursed thereby and make a report thereof to the library board monthly or as often as the board requires.
(d) Appointments
(1) The Mayor of the City of Florence shall appoint, with the approval of the governing body, a library board consisting of seven members.
(2) In addition to the appointed members of the board; the Mayor of the City shall be an ex officio member of the library board with the same powers as appointed members.
(3) No person holding any office in the city shall be appointed a member while holding such office.
(e) Term Duration of appointment to the library board shall be for four years.
(f) Eligibility
(1) All members appointed to the library board shall be residents of the City of Florence.
(2) Vacancies occasioned by removal from the municipality, resignation or otherwise, shall be filled by appointment for the un-expired term.
(3) A limit of two consecutive four-year terms to the library board shall be allowed.
(4) An individual may be re-appointed to the library board two years after the expiration of the individuals second appointed term.
(5) Library board members shall receive no compensation, although, they shall be allowed their actual and necessary expenses in attending meetings and in carrying out their duties as members.

The library boards shall have the following powers and duties.
(a) To make and adopt rules and regulations for the administration of the library
(b) With the approval of the governing body of the City of Florence, to purchase or lease a site or sites and lease or erect a building or building for the use of the library;
(c) To acquire by purchase, gift, or exchange, books. Magazines, papers, printed materials, slides, pictures, films, projection equipment phonograph records and other material and equipment deemed necessary by the board for the maintenance and extension of modern library services;
(d) To employ a librarian and such other such employees as the board deems necessary and to remove them and fix their compensation;
(e) To receive, accept and administer any money appropriated or granted to it by the state or the federal government or any agency or subdivision thereof for the purpose of aiding or providing library service;
(f) To make annual reports; to the state librarian and the governing body of the City of Florence on or before January 31 of each year. Said reports should include:
(1) Receipts and disbursements from all funds under its control and;
(2) Provide statistical information relating to library materials acquired and on hand, number or library users and library service, available;
(3) Other information of general interest as the governing body requires.
(g) The Florence Public Library receiving money from sources other than a tax levy for library purposes shall place such money in a separate fund or funds, acceptable with general accounting standards. Said funds are the responsibility of the Florence Library Board Trustees; and shall be included in the financial accountability to the governing body of the City.

Taxes shall be levied and collected in like manner as other taxes of the City of Florence and except for an amount to pay a portion of the principal and interest on bonds issued under the authority of K.S.A. 12-1774, and amendments thereto, shall be kept in a separate fund to be known as the library fund of the City of Florence. K.S.A. 12-1220 and amendments thereto. The City of Florence after receipt of appropriate funds shall distribute them in a timely manner to the treasure of the Florence Public Library.

A budget prepared by the library board shall be submitted by the treasure of the library board to the governing body of the City of Florence by July 1 for the following budget year.

The library board can establish a capital improvement fund as provided in K.S.A. 12-1258 and K.S.A. 12-1268.
(a) In making the budget of the library the amounts credited to the amount on hand in the capital improvement fund and the amount expended therefrom shall be shown on the budget for the information of the taxpayers of the City of Florence in which the library is located.
(b) Moneys in such fund may be invested in accordance with the provisions of K.S.A. 10-131 and amendments thereto, with interest thereon credited to such fund.

As provided in Section 1-801, Levy limit shall be 6 mills; provided that the first 2 mills of said levy shall be outside the aggregate tax levy limit prescribed in that section.

The library building is titled to the Library Board of the City of Florence, Marion County, Kansas. The deed is recorded in Book 335, Page 296, as Lot 324, Main Street, Florence, Kansas
(a) The library building is owned by the Library Board of the City of Florence.
(1) The library board shall constitute a body corporate and politic, possessing the usual powers of a corporation for public purposes, under the name and style of “the Library Board of Trustees of the Florence Public Library” and under such name may contract, sue, and be sued and acquire, hold and convey real and personal property in accordance with law. The acquisition or disposition of real property shall be subject to the approval of the governing body of the City of Florence.
(b) Clarification of responsibility;
(1) The library board shall be responsible for insurance, care, maintenance and utilities of the entire structure;
(2) The City of Florence will furnish water for the public library proper
(3) The library board in its power may lease, rent or utilize other portions of the building not needed for the library proper;
(4) Any income derived from any lease, rental or utilization agreements will be recorded and accountable within the accounting structure as outlined by the library board and those moneys may be used for the library at the discretion of the library board;
(5) The library board may elect to change the physical locations of the library. Upon such decision the existing library building shall be sold by the library board and those funds will be used to help finance a different facility along with perpetuating the needs of the library. This shall be subject to the approval of the governing body of the City of Florence;
(6) If the library board of the City of Florence becomes inactive or no longer exists, the building at 324 Main Street, Florence, Kansas or any other owned building shall become the responsibility of the City of Florence. Whereas; if the building is sold by the governing body of the City of Florence, the funds generated will be credited to the city’s capital improvement fund.
